Idaho prosecutes impaired driving as DUI under Idaho Code § 18-8004, which covers impairment by alcohol, drugs, or any other intoxicating substance, alone or in combination, and sets the per se BAC at 0.08. Idaho is one of the few states that codifies the 0.04 commercial motor vehicle threshold directly in the DUI offense statute (§ 18-8004(1)(b)). The under-21 threshold is a measured 0.02 (§ 18-8004(1)(d)). The standard penalty ladder runs three tiers: a first offense is a misdemeanor (≤6 months, ≤$1,000, 30-day absolute + 60–150-day restricted suspension, IID for 1 year); a second within 10 years carries a 10-day mandatory minimum, ≤1 year, ≤$2,000, and a 1-year absolute suspension; a third or subsequent within 10 years is a FELONY (≤10 years penitentiary, ≤$5,000, 1–5 year suspension). A prior felony DUI within 15 years automatically makes any further DUI a felony regardless of the 10-year counter. Running parallel to that ladder is the 'excessive DUI' scheme for a BAC of 0.20% or more (§ 18-8004C), which overrides § 18-8005: a first 0.20%+ offense is a misdemeanor but carries a 10-day mandatory minimum, up to 1 year, up to $2,000, and a 1-year absolute suspension; a second 0.20%+ offense within 5 years is a FELONY (up to 5 years, up to $5,000) — so an excessive-DUI defendant can become a felon on a second offense, without the three-offense count the standard ladder requires. IID is mandatory at every tier and after refusal. Refusing an evidentiary test carries a $250 civil penalty, a 1-year (or 2-year) absolute suspension, and mandatory IID — separate from any criminal conviction. Idaho's implied consent law provides no right to consult an attorney before testing. The statute was most recently amended in 2025 (ch. 171).

Does Idaho require an ignition interlock device after a DUI?
